Arlington,Va. In a ruling that may bring an end to the years long battle
to save Charlie Birnbaums longtime family home from
condemnation, Judge Julio Mendez today ruled that the Casino Reinvestment
Development Authority attempt to take Birnbaums
property was a manifest abuse of the eminent domain power and dismissed
the states condemnation action once and for all.

This is a victory for property rights, common sense, and the
people of New Jersey,
said. The CRDA position was that they could take Charlies
property for any reason or for no reason, just because they wanted it. Todays ruling
emphatically says otherwise.

the CRDA filed condemnation papers in early 2014 that sought to seize the home Birnbaum inherited from his parents. Joining forces
